VEGAS-GellyBall Liability Waiver & Release of Liability

Important Notice:

By signing this document, I understand I am giving up certain legal rights, including the right to sue. I agree to read it carefully before signing.

If participant is a minor (under 18):

Activity Description:

I understand that VEGAS-GellyBall provides mobile, supervised GellyBall (gel blaster) games and related activities (“Activity”). I understand the Activity may include running, quick movements, uneven ground, obstacles/inflatables, and use of commercial-grade, battery-powered blasters that launch hydrated gel orbs. Assumption of Risk

I understand and voluntarily accept that participation involves inherent risks, including but not limited to:

• Being struck by gel orbs; minor pain, red marks

• Slips, trips, falls, collisions with people/objects/inflatables

• Strains, sprains, fractures, concussion, eye injury (including serious injury if protective gear is not worn properly)

• Allergic reactions, dehydration, heat illness, or other medical events

• Property damage to personal items (phones, glasses, clothing)

I voluntarily assume all risks, known and unknown, even if arising from the negligence of the Released Parties (defined below), to the fullest extent permitted by Nevada law. Safety Rules & Required Protective Gear

I agree that:

• Eye/face protection is mandatory at all times during gameplay.

• Masks/helmets must remain on while shots are being fired and within the gameplay area. (Must wear close-toed shoes)

• No point-blank shooting; maintain minimum distance as instructed (commonly at least 6 feet).

• No shooting anyone with hands up; respect “ceasefire” and staff instructions immediately.

• No drugs or alcohol; respectful conduct is required.

• VEGAS-GellyBall may deny or remove any participant for safety or rule violations.

I understand failure to follow rules increases risk of injury and may result in removal without refund.

Health Representation

I represent that I (and/or my minor child) am physically able to participate. I understand the Activity is not recommended for pregnant individuals or anyone unable to participate in physical activity. I agree to disclose relevant medical conditions to staff if asked and to stop participation if I feel unsafe or unwell.

Medical Authorization

If I (or my minor child) require medical attention, I authorize VEGAS-GellyBall staff to obtain emergency medical care, including calling 911, and I agree I am solely responsible for all medical costs. I understand VEGAS-GellyBall staff are not acting as medical professionals.

Release of Liability (Waiver)

In consideration for being allowed to participate, I, for myself and on behalf of my heirs, assigns, and personal representatives, hereby release, waive, discharge, and covenant not to sue:

• VEGAS-GellyBall and its owners, officers, directors, employees, contractors, volunteers, agents, affiliates, successors, and assigns;

• the property owner/host venue (if applicable);

• event sponsors/partners (if applicable)

(collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, costs, and expenses (including attorney’s fees) arising out of or related to participation in the Activity, including but not limited to personal injury, death, property damage, or medical expenses, whether caused by negligence or otherwise, to the fullest extent permitted by law.

Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising from:

• my (or my minor child’s) participation;

• my (or my minor child’s) breach of this agreement;

• my (or my minor child’s) negligent or intentional acts or omissions.
  

Minor Participant Agreement

If signing as a parent/legal guardian, I:

• consent to the minor’s participation;

• agree to all terms on behalf of the minor;

• release and waive claims that the minor may have against the Released Parties;

• agree to indemnify the Released Parties for claims brought by or on behalf of the minor.

Photo/Video Release (Optional)

I grant VEGAS-GellyBall permission to use photos/video of me/my minor child taken during the Activity for lawful business purposes (marketing, social, website) without compensation. (We only use photos when kids have helmets on)

Equipment Responsibility

I agree to treat all equipment with care and follow all handling instructions. I may be responsible for damage due to misuse, intentional damage, or failure to follow staff instructions.

Weather / Event Conditions

I understand gameplay may be paused or modified due to weather or unsafe conditions (e.g., high winds or extreme conditions) as determined by VEGAS-GellyBall for safety.

Governing Law / Venue

This agreement shall be governed by the laws of the State of Nevada. The parties agree that any dispute arising from this agreement or the Activity shall be brought in the appropriate courts located in Nevada, and I consent to personal jurisdiction and venue there.

Severability

If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

This document contains the entire agreement regarding liability and risk for the Activity and supersedes prior discussions or representations.

Acknowledgment & Signature

I certify that I have read and understood this waiver, that I am signing it voluntarily, and that I am at least 18 years old (or the parent/legal guardian of the minor participant).
